My neighbour started work without telling me

It happens more often than you might think, usually through ignorance rather than bad faith. You have options, and acting quickly gives you the most protection.

Step 1: check whether the work needs a notice

Not all building work is covered. Work to the shared wall, a new wall at the boundary or deep digging near your house usually is. Interior work away from the wall usually is not. Our quick check can help.

Step 2: record what you can see

Take dated photos of your side of the shared wall, the boundary and any cracks or damage. Note dates and what work was happening.

Step 3: speak to your neighbour

Many owners simply do not know about the Act. A calm conversation explaining that notice is needed often resolves it.

Step 4: put it in writing

If talking does not work, write to the neighbour asking them to stop the notifiable work and serve notice. Keep a copy.

If the work continues, you can apply to the court for an injunction to stop it until the Act is followed. Courts have also allowed claims for damage where the Act was ignored, and they can be less forgiving to an owner who skipped the process. Take advice before going to court; it is costly.

If damage has already happened

Even without notice, you can claim for damage caused by the work. Your photographs and early complaints will matter.

Has a notice landed on your doormat?

Ivan Larkin can read it through with you, explain your choices and act as your surveyor. In most cases the owner doing the work pays for that.
